Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF)
What is AML/CTF?
Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws are designed to protect Australia’s financial system and economy by preventing criminals from using legitimate businesses and transactions, including real estate transactions, to conceal the proceeds of crime, launder illicit funds or finance terrorism.
Certain real estate services in Australia are regulated under Australia’s AML/CTF laws. Real estate businesses providing these regulated services are required to comply with applicable obligations administered by the Australian Transaction Reports and Analysis Centre (AUSTRAC).
Why is Levy Property Group requesting this information?
Levy Property Group is committed to complying with its obligations under Australia’s AML/CTF laws when providing regulated real estate services.
As part of these obligations, we may be required to collect, verify and maintain certain information about our clients and customers before providing particular services or proceeding with certain transactions.
We understand that providing personal and financial information can sometimes feel intrusive. Levy Property Group aims to make the process as straightforward as possible while ensuring we meet our legal and regulatory obligations.
What is Customer Due Diligence?
Customer Due Diligence (CDD) is the process of identifying and verifying customers before providing certain regulated real estate services.
If you are selling or purchasing property through Levy Property Group, we may be required to undertake Customer Due Diligence before providing a regulated service.
Depending on the individual, entity and circumstances of the transaction, this process may include:
confirming and verifying your identity;
identifying who owns or controls a company, trust or other legal entity involved in the transaction;
identifying and verifying beneficial owners;
understanding the nature and purpose of the transaction or business relationship; and
undertaking additional checks where a customer or transaction presents a higher level of risk.
What information may we request?
The information required will depend on your individual circumstances, the ownership structure involved and the nature of the transaction.
Levy Property Group, or an authorised third-party AML/CTF compliance or identity verification provider acting on our behalf, may request information or documentation including:
your full name;
date of birth;
residential address;
occupation;
information from identification documents, such as a driver licence or passport, for the purpose of verifying your identity;
information regarding the ownership and control of a company, trust, partnership or other legal entity;
information identifying the ultimate beneficial owners of an entity;
information to help us understand the nature and purpose of the transaction; and
where required, information regarding the source of funds or source of wealth connected with a transaction.
Additional information or documentation may be requested where necessary to meet our legal and regulatory obligations.
How will this information be used?
The information we collect may be used to:
verify the identity of our clients and customers;
undertake Customer Due Diligence;
understand the ownership and control of companies, trusts and other legal entities;
assess and manage money laundering and terrorism financing risks;
confirm the nature and purpose of a transaction or business relationship;
comply with our legal and regulatory obligations;
maintain records required by law; and
meet any applicable reporting obligations to AUSTRAC or other government and regulatory authorities.
How will Levy Property Group handle your personal information?
Levy Property Group recognises the importance of protecting your personal information.
We will only collect, use, hold and disclose personal information as reasonably necessary to meet our AML/CTF, legal, regulatory and business obligations.
Information collected for AML/CTF purposes will be handled in accordance with applicable privacy laws and Levy Property Group’s Privacy Policy.
Where we engage an external service provider to assist with identity verification, Customer Due Diligence or other AML/CTF compliance requirements, information may be provided to that service provider where reasonably necessary to complete the required checks.
For further information about how Levy Property Group collects, holds, uses and protects personal information, please refer to our Privacy Policy.
What happens if the requested information is not provided?
Providing certain information and documentation may be necessary for Levy Property Group to comply with its legal obligations.
If you do not provide the information or documentation requested, or if we are unable to satisfactorily complete the required Customer Due Diligence process, Levy Property Group may be unable to provide certain regulated real estate services or proceed with a transaction until the necessary requirements have been satisfied.
We appreciate your understanding and cooperation as we work to meet our legal obligations and help protect the integrity of Australia’s property market and financial system.
